NARCOANALYSIS
WHAT IS IT?
Psychotherapy conducted while the patient is in a sleeplike state induced by barbiturates or other drugs, especially as a means of releasing repressed feelings or thoughts. Also called narcosynthesis. It is also called the truth serum test.
· A person is able to lie by using his imagination. In the Narcoanalysis Test, the subject's imagination is neutralised by making him semi-conscious. In this state, it becomes difficult for him to lie and his answers would be restricted to facts he is already aware of. Experts inject the subject with Sodium Pentothal or Sodium Amytal. The dose is dependent on the person's sex, age, health and physical condition. A wrong dose can result in a person going into a coma, or even death.
· The subject is not in a position to speak up on his own but can answer specific but simple questions. The answers are believed to be spontaneous as a semi-conscious person is unable to manipulate the answers.
DRUG USED
· A few of the best known drugs are Seconal, Hyoscine (scopolamine), Sodium Pentothal, Sodium Amytal, Phenobarbital. Most commonly used drug for truth serum test is an anesthetic and sedative drug, Soduium Pentothal which when administered intravenously can make a person garrulous and confessional.
· The narcoanalysis test is conducted by mixing 3 grams of Sodium Pentothal dissolved in 3000 ml of distilled water. Depending on the person’s sex, age, health and physical condition, this mixture is administered intravenously along with 10% of dextrose over a period of 3 hours with the help of an anaesthetist. Wrong dose can send the subject into coma or even result in death.
In India, a controlled dosage of the drug sodium pentathol is administered which will enable the person to be in a state of disinhibition (a state when the person has crossed inhibition) as long as the task of obtaining revelations requires. The drug is administered to the subject after taking his/her consent.
PSYCHOANALYTICAL TESTS
The three tests - the polygraph or lie detector test (that determines whether a person is lying), the P-300 or brain mapping and narcoanalysis - are all tools employed by forensic experts. These test are used by investigators to cross check their findings, determine if a suspect is telling the truth or make him reveal facts pertaining to a case.
LEGALITIES
For polygraph and brain mapping tests, no court permission is required. But unlike them, narcoanalysis is an invasive procedure where the subject is lulled by being injected with an anaesthetic, making a court permission mandatory.
TEST SUBJECTS
· The test was first administered in 2000 on a Veerappan aide.
· It was used in 2002 in the Godhra carnage probe.
· It was also in news after the famous Arun Bhatt kidnapping case in Gujarat wherein the accused had appealed to the NHRC and the Supreme Court against undergoing the narcoanalysis test.
· It was again in news in the Telgi stamp paper case and was made famous when Abdul
· Karim Telgi was subjected to the said test in December 2003 at a government hospital in Bangalore.
· Naresh Pardesi, associate of Maharashtra MLA and former don Arun Gwali, was administered the narco test.
· In the past, the forensic science laboratory in Gandhingar has helped convict a serial killer who had murdered eight people in Ujjain.
· The FSL has also helped in investigations in the Telgi case, the Anara Gupta CD case and carried out brain mapping of Ghutka barons JM Joshi and Dhariwal.
· Abu Salem undergoes the lie detector (polygraph), brain mapping and narco-analysis test in 2005.
· The Bombay train blasts case, the Nithari killers case, and the "beer killer" case in Mumbai (2007) are few examples of recent cases that involved narcoanalysis.
ARE THESE TESTS ADMISSIBLE IN COURT
Lawyers are divided on whether the results of Narco Analysis and P300 tests are admissible as evidence in courts.
· "Confessions made by a semi-conscious person is not admissible in court. A Narcoanalysis Test report has some validity but is not totally admissible in court, which considers the circumstances under which it was obtained and assess its admissibility," advocate P R Vakil told. "Under certain circumstance, a person may hold a certain belief. By repeatedly thinking about an issue in a particular way, he begins to believe that what he is thinking is right. But it need not necessarily be the truth," Vakil explained.
· "Results of such tests can be used to get admissible evidence, can be collaborated with other evidence or to support other evidence. But if the result of this test is not admitted in a court, it cannot be used to support any other evidence obtained the course of routine investigation."
· Criminal lawyer Majeed Memon said, "If the courts give permission to conduct these tests, then only it can decide the admissibility of the test results and other related evidence. Such reports can be used as evidence or to support other evidence."
· Another criminal lawyer Sham Keswani has a different view। "Such tests don't have any legal validity. They can only assist the police investigation."But, in case a person is not affected by the chemical, he might take some wrong names (to mislead investigators). The results of such tests can be used to support other evidence," he said.
